This does seem to be one of the key questions. I can see arguments where: I am not specifically using their data to target my services at the **individuals** specifically (maybe only collecting large metrics to target demographics) - though that argument probably wouldn't hold water

I imagine if your site became commercial you would need to be transparent about what data you collect, keep collection minimal, and offer a way for people to opt out. The next question is what constitutes a commercial site
